1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the ProdOps HQ platform (“Service”). By creating an account, you agree to be bound by these Terms, our Privacy Policy, and our Data Processing Agreement.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of Service
ProdOps HQ is an engineering productivity platform that connects to your organisation's third-party tools (such as GitHub and Jira) to provide insights into delivery pipeline performance, team health, and developer activity. The Service processes data from these integrations to generate metrics, dashboards, and reports.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it up to date.
You must notify ProdOps HQ promptly if you become aware of any unauthorised use of your account.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law or regulation
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorised access to the Service or its related systems
- Use the Service to transmit malicious code or harmful content
- Reverse engineer, decompile, or disassemble any part of the Service
5. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. When ProdOps HQ processes personal data on your behalf as a data processor, the terms of our Data Processing Agreement apply.
You retain ownership of all data you submit to or connect with the Service. ProdOps HQ uses your data solely to provide and improve the Service.
6. Intellectual Property
ProdOps HQ and its licensors retain all rights, title, and interest in the Service, including all related intellectual property. These Terms do not grant you any rights to use ProdOps HQ's trademarks, logos, or brand features.
7. Limitation of Liability
To the maximum extent permitted by law, ProdOps HQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.
ProdOps HQ's total aggregate liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid to ProdOps HQ in the twelve (12) months preceding the claim.
8. Termination
You may terminate your account at any time by contacting us. ProdOps HQ may suspend or terminate your access if you breach these Terms or if continued provision of the Service becomes impractical or unlawful.
Upon termination, your right to use the Service ceases immediately. Data retention and deletion following termination are governed by our Privacy Policy and Data Processing Agreement.
9. Changes to These Terms
ProdOps HQ may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
